Terms and Conditions

Welcome to Elevate. These Terms and Conditions (“Terms”) govern your use of the websites, mobile applications, and educational services (collectively, the “Services”) provided by SG Elevate, A Division of Solvonovate Global Private Limited (“we,” “us,” “our,” or “the Company”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, accessing content, or using any feature of the Elevate platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of a school or educational institution, you represent that you have the authority to bind that entity.

2. Definitions

  • “Platform” refers to the Elevate website, mobile app, and related software.

  • “User,” “You,” “Your” refers to the individual using the Platform, including students, parents, teachers, and administrators.

  • “Student Data” refers to any information, educational records, or assignments submitted by or on behalf of a student.

  • “School” refers to the educational institution (K-12, university, etc.) that has contracted with Elevate to provide services to its students.

3. Eligibility and Accounts

  • Age Requirement: You must be at least 13 years old to use the Services. If you are between 13 and 18, you represent that you have obtained parental or legal guardian consent to use the Platform.

  • School-Authorized Accounts: If your account is provided by your School, your use is subject to your School’s policies. Your School may revoke or suspend your access at any time.

  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Educational License and Use of Content

  • License: Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Platform for educational, non-commercial purposes.

  • Ownership: All content provided on the Platform (courses, videos, text, graphics, software) is the property of Solvonovate Global or its licensors and is protected by intellectual property laws.

  • Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

5. User Conduct and Content
A. Acceptable Use

You agree to use the Platform only for lawful purposes. You will not:

  • Use the Platform to harass, abuse, or harm others.

  • Impersonate any person or entity.

  • Attempt to gain unauthorized access to another user’s account or the Platform’s systems.

  • Use the Platform to upload viruses or malicious code.

  • Use any robot, spider, or other automatic device to scrape the Platform.

B. User-Generated Content

By submitting assignments, forum posts, or other content (“User Content”), you grant Elevate a worldwide, royalty-free license to host, store, and use that content solely for the purpose of providing the Services to you and your School. You retain ownership of your intellectual property rights.

6. Privacy and Student Data

Your use of the Platform is governed by our Privacy Policy. We take the confidentiality of Student Data seriously.

  • Data Ownership: We consider Student Data to be owned by and under the control of the student and their School.

  • No Sale of Data: We do not sell Student Data or use it for targeted advertising.

  • FERPA/COPPA Compliance: For users in the United States, we comply with applicable provisions of FERPA and COPPA. We act as a “School Official” with a legitimate educational interest.

7. Fees and Payments

  • Free vs. Paid Services: Some features of Elevate may be free, while others require payment. If your School has purchased access, your Terms are managed by the agreement between Elevate and the School.

  • Billing: If you purchase directly, you agree to pay all fees and taxes associated with your subscription. Fees are non-refundable except as required by law or as specified in your agreement.

  • Renewals: Subscriptions automatically renew unless canceled before the renewal date.

8. Third-Party Links and Tools

The Platform may integrate with third-party services (e.g., Google Classroom, Zoom) or contain links to external sites. We do not control these third parties and are not responsible for their content, privacy policies, or practices.

9. Termination

We reserve the right to suspend or terminate your access to the Services at our discretion, without notice, if you violate these Terms.

  • By You: You may delete your account at any time via account settings or by contacting support.

  • By School: Your School may terminate your access based on their internal policies.
    Upon termination, your right to access the Platform will cease immediately.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATE AND SOLVONOVATE GLOBAL DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ELEVATE OR SOLVONOVATE GLOBAL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Elevate, Solvonovate Global, its affiliates, and their respective employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Services or your violation of these Terms.

13. Modifications to Terms

We may revise these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice on the Platform. By continuing to access or use the Services after revisions become effective, you agree to be bound by the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of [Insert State/Country], without regard to its conflict of law provisions.

  • Informal Resolution: Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at hello@sgelevate.online.
